國道5號上個月發生蝶戀花旅行社遊覽車翻車事故，交通部觀光局事後立即停止該公司經營旅行業務，全案經過相關單位調查，觀光局認定蝶戀花旅行社違法經營核准登記範圍外事務，今（20）日依發展觀光條例及消費者保護法規定，廢止蝶戀花旅行社旅行業營業執照。
國道5號遊覽車事故發生超過1個月，交通部今天下午舉辦記者會，說明國道5號遊覽車事故善後保險理賠及改善作為，觀光局副局長張錫聰表示，2月14日觀光局依消費者保護法第36條、38條規定，立即停止蝶戀花公司經營旅行業務，由於蝶戀花旅行社違規情節重大，今天廢止旅行業營業執照。
為何拖了1個月才廢止旅行業營業執照，張錫聰解釋，因事故發生後仍需調查釐清，經勞動主管機關北市勞工局檢查，發現該公司以靠行友力通運公司方式經營遊覽車業務，事故車輛及罹難駕駛皆為其公司所有，明顯違法經營核准登記外事業，因此廢止旅行業營業執照。
另外，這起事故33名罹難者中的31名已完成治喪，也陸續完成保險理賠程序；受傷的11人中已有7人出院，尚有4人仍在醫院治療，目前都已脫離險境，共有3人完成理賠，觀光局也會持續協助家屬後續相關保險理比價賠事宜。

對於民眾投訴指控台西客運公司違法，雲林縣府工務處運輸管理科與雲林監理站都表示，如果稽查屬實，將依法開罰，輕者罰款，重者取消補助，甚至撤銷路權。
縣府運輸管理科長廖?鋒指出，依《公路法》規定，由縣市政府補助的綠色車牌縣市公車，不得跨縣市運輸乘客，除非申請到路權，例如部分嘉義客運也行駛到雲林，而雲林的台西客運也有開往嘉義的路線，若未按原申請路線及停靠站停靠，都於法不符。
廖?鋒說，經稽查發現違法屬實，將請業者提出說明並限期改善，且裁罰9000至9萬元不等罰款，如果再不改善，得連續罰款，嚴重者將停止路權，並取消補助。
雲林監理站運輸管理股長羅淑娟表示，通常公部門補助款係針對路線補貼，換言之就是以行駛里程數及班次作為補助依據，如果業者有按照補貼合約路線及往返班次行駛，因時制宜增加班次，其用於加班的車輛使用年限不受《公路法》規範，倘被稽查違法屬實，輕者罰款，重者取消路線補貼，至於撤銷路權，則有待商榷。
羅淑娟不諱言，雲林偏鄉很多，許多家戶幾乎都有轎車或機車，搭公車的人很少，學生是大宗，再來就是老人，不少路線都是虧本經營，業者根本不想跑，政府為了照顧弱勢老人婦孺等行的方便，所以才補貼業者，如果撤銷路權，業者樂得輕鬆，反而造成弱勢無車可搭。
